4. Your Customers' Data
When you use Owners Pulse to manage your customers, you are the data controller for your customers' personal information. We are the data processor acting on your instructions.
Your responsibilities:
- You must have a lawful basis for collecting and processing your customers' data
- You must inform your customers about how their data is used (including automated SMS/email)
- You must honor your customers' opt-out requests
- You must comply with TCPA (Telephone Consumer Protection Act) for SMS/calls
- You must comply with CAN-SPAM Act for commercial emails
Our responsibilities:
- We process your customers' data only as instructed by you through the platform
- We implement appropriate security measures to protect your customers' data
- We do not use your customers' data for our own marketing purposes
- We assist you in responding to your customers' data requests (access, deletion, etc.)
- We delete your customers' data when you close your account (see Section 7)
5. GoHighLevel (GHL) Data Processing
Owners Pulse is built on GoHighLevel (GHL) infrastructure for CRM, marketing automation, and communication features. When you use Owners Pulse:
- Your business data and customer data are stored in GHL's systems
- SMS and email communications are sent through GHL's infrastructure (powered by Twilio/LC Phone for SMS and Mailgun for email)
- The AI Phone Receptionist uses GHL's AI Employee feature
- Workflow automations (review requests, follow-ups, campaigns) execute within GHL
GHL processes data in accordance with their privacy policy. Data is stored on servers in the United States.
6. SMS and Phone Communication Compliance
6.1 TCPA Compliance
All SMS and phone communications sent through Owners Pulse comply with the Telephone Consumer Protection Act (TCPA):
- Your customers must consent to receive SMS/calls from your business
- Every SMS includes opt-out instructions ("Reply STOP to unsubscribe")
- Opt-out requests are processed immediately and automatically
- We maintain records of consent and opt-out requests
- Communications are sent only during permissible hours
6.2 A2P 10DLC Registration
Business SMS sent through Owners Pulse uses A2P (Application-to-Person) 10DLC registered phone numbers:
- Your brand is registered with The Campaign Registry (TCR)
- Message campaigns are registered and approved before sending
- This ensures higher delivery rates and regulatory compliance
6.3 AI Phone Receptionist
When the AI Phone Receptionist (Domination plan) answers calls on your behalf:
- Call content may be processed by AI to generate responses and book appointments
- Callers are not explicitly informed they are speaking with AI unless required by applicable law
- Call data (caller number, call duration, appointment details) is stored in your CRM
- Call recordings, if enabled, are stored securely and accessible only to you
7. Data Retention and Deletion
7.1 Active Accounts
While your account is active, we retain all data necessary to provide the Service including your business data, customer data, communication history, and usage logs.
7.2 Account Cancellation
When you cancel your subscription:
- Your access is terminated at the end of the billing period
- We retain your data for 30 days after cancellation to allow for reactivation
- After 30 days, we initiate data deletion
- Complete data deletion is processed within 90 days of cancellation
- Some data may be retained longer for legal, tax, or regulatory obligations (e.g., billing records for 7 years)
7.3 Data Deletion Requests
You can request deletion of your personal data at any time by contacting contact@ownerspulse.com. We will process deletion requests within 30 days.
Deleting your data will terminate your account. Some data may be retained for legal obligations. Data that has been anonymized or aggregated cannot be deleted (it is no longer personal data).
7.4 Your Customers' Data
When you delete a customer from your CRM, that customer's data is permanently deleted from your sub-account within 30 days. If you cancel your account entirely, all customer data is deleted per the schedule above.

We implement appropriate technical and organizational measures to protect your data:
Encryption in Transit
All data transmitted between your browser and our servers uses TLS 1.2+ encryption (HTTPS)
Encryption at Rest
Sensitive data stored in our databases is encrypted at rest using AES-256
Access Controls
Access to production systems is restricted to authorized personnel with multi-factor authentication
Infrastructure Security
Hosted on AWS and Vercel with enterprise-grade security, DDoS protection, and automatic patches
Payment Security
All payment processing is handled by Stripe (PCI DSS Level 1 certified). We never store full card numbers.
Regular Audits
We conduct regular security reviews and monitor for vulnerabilities

10. Your Privacy Rights

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA):

Owners Pulse is designed for businesses, not individuals under 18. We do not knowingly collect personal information from children under 13 (or 16 in the EEA). 12. International Data Transfers
Owners Pulse is based in the United States. If you access the Service from outside the United States, your data will be transferred to and processed in the United States.
